on December 20, 2022 the Office of Drug and Alcohol Policy and Compliance posted a Statement of Enforcement Discretion authorizes Substance Abuse Professionals (SAP) to conduct remote assessments and evaluations for employees with drug and alcohol violations.

The U.S. Department of Transportation’s (DOT) Office of Drug and Alcohol Policy and Compliance (ODAPC) issues this statement of enforcement discretion, effective January 1, 2023.  Unless otherwise modified or terminated by ODAPC, the enforcement discretion ends on the effective date of any final rule following DOT’s notice of proposed rulemaking (NPRM) published on February 28, 2022.  SAPs and affected employees would follow any assessment and evaluation procedures specified in that final rule.

On May 6, 2022, the Office of Drug and Alcohol Policy and Compliance posted its updated Substance Abuse Professional (SAP) guidelines.  A listing of the updates can be found on the last page of the guidelines.  The document can be found at https://www.transportation.gov/odapc/sap.

On June 15, 2022, the Office of Drug and Alcohol Policy and Compliance updated its Statement of Enforcement Discretion for Substance Abuse Professionals and Service Agents guidance document.  The document extends the guidance for SAPs to conduct remote assessments and evaluations until December 31, 2022 and terminates the guidance regarding the service agent’s requalification timelines.  You can view the updated guidance at https://www.transportation.gov/odapc/program-guidance.

New SAP Evaluations Update for the DOT  is a specific term used only for the (DOT) Department of Transportation Federal rule regulations violation 49 CFR Part 40 DOT Drug and Alcohol Testing. What to consider when choosing a Substance Abuse Professional SAP Evaluations

The US Department of Transportation (DOT) requires companies employing individuals who hold commercial driver licenses (CDLs) to perform random, pre-employment, post-accident, reasonable suspicion, and return-to-duty drug and alcohol tests. Under 49 Code of Federal Regulations (CFR) Part 40, any individual who tests positive for drugs or alcohol must be referred to a qualified SAP who will provide a comprehensive, face-to-face assessment and clinical evaluation and recommend a course of treatment. These regulations apply to FAA, FMCSA, FRA, FTA, RSPA, and USCG.

The US Department of Transportation (DOT) requires specialized training for Substance Abuse Professionals (SAPs) conducting DOT-compliant substance evaluations for employees in safety-sensitive duties. In addition to substance abuse certification, DOT SAPs must complete 12 hours of specialized training every three years and pass a national exam specific to DOT guidelines.   • Written reports sent to the employer’s designated representative apprising them of referrals, monitoring, and recommendations
